Waste Collection Stockwell Service Terms and Conditions
These Terms and Conditions set out the basis on which Waste Collection Stockwell provides waste collection and related services to customers. By booking a waste collection or using any of our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below.
Customer means any individual, business, or organisation that requests or uses our waste collection services.
Service means any waste collection, removal, loading, transportation, recycling, or disposal service provided by Waste Collection Stockwell.
Booking means a confirmed request for the Service made by the Customer and accepted by Waste Collection Stockwell.
Waste means any items, materials, rubbish, refuse, junk, or other discards presented by the Customer for collection, excluding any prohibited items as defined by law or these Terms and Conditions.
Site means the location at which the Waste is to be collected.
2. Scope of Service
Waste Collection Stockwell provides waste collection and related services for domestic and commercial customers within its service area. The specific details of the Service, including type of waste, quantity, collection date, and any special requirements, will be confirmed at the time of Booking.
The Service is limited to the collection and lawful disposal or recycling of Waste that is properly declared, accessible, and compliant with applicable waste regulations. We do not provide building or structural work, plumbing, electrical services, or services outside the scope of waste management.
3. Booking Process
3.1 Making a Booking
Customers may request a Booking by telephone, email, or other communication channels made available by Waste Collection Stockwell. To make a Booking, the Customer must provide accurate and complete information, including:
The type and approximate quantity or volume of Waste to be collected.
The Site address and any access details or restrictions.
The preferred date and time window for collection.
Any special handling requirements, such as bulky items, heavy loads, or sensitive materials.
3.2 Confirmation of Booking
A Booking will only be considered confirmed once Waste Collection Stockwell has accepted the request and provided confirmation to the Customer. Confirmation may be given verbally, in writing, or through electronic communication.
We reserve the right to refuse any Booking at our discretion, including where the Waste is not suitable for our Service, the Site is inaccessible, or the requested time cannot be accommodated.
3.3 Amending a Booking
Customers may request changes to a Booking, such as altering the time, date, or estimated volume of Waste. All amendments are subject to availability and must be agreed by Waste Collection Stockwell. Additional charges may apply where changes affect the duration, resources required, or nature of the Service.
4. Customer Obligations
The Customer agrees to:
Provide accurate information about the Waste and the Site at the time of Booking.
Ensure that Waste is properly presented for collection, separated where required, and does not include prohibited or hazardous items unless expressly agreed in advance and permitted by law.
Provide safe, reasonable, and timely access to the Site for our staff and vehicles, including any necessary entry codes, instructions, or permissions.
Ensure that children, pets, and other persons are kept at a safe distance while the Service is being performed.
Comply with all applicable laws, regulations, and local requirements relating to Waste, including any rules relating to specific materials.
If the Customer fails to meet these obligations, Waste Collection Stockwell may refuse to carry out all or part of the Service, and may charge a cancellation or call-out fee.
5. Payments and Charges
5.1 Pricing
Prices for our services are normally based on the type and estimated volume or weight of Waste, the time required to complete the collection, and any additional labour or special handling required. Indicative prices may be provided in advance, but final charges may be adjusted to reflect the actual Waste collected and work performed.
5.2 Payment Terms
Unless otherwise agreed in writing, payment is due on completion of the Service on the day of collection. We may require full or partial payment in advance for certain Bookings, including large jobs or commercial contracts.
Payments may be made by cash, bank transfer, or other payment methods accepted by Waste Collection Stockwell from time to time. The Customer is responsible for ensuring that payment details are correct and that sufficient funds are available.
5.3 Late or Non-Payment
If payment is not made when due, Waste Collection Stockwell may:
Apply reasonable administration charges for late payment.
Charge interest on overdue amounts at the maximum rate permitted by law.
Withhold further services or cancel future Bookings until all outstanding sums are settled.
Any costs incurred in recovering unpaid amounts, including reasonable legal or collection costs, may be charged to the Customer.
6. Cancellations and Rescheduling
6.1 Customer Cancellations
The Customer may cancel a Booking by giving notice to Waste Collection Stockwell. Cancellations should be made as early as possible before the agreed collection time.
Where the Customer cancels with at least 24 hours notice before the scheduled collection time, no cancellation fee will normally apply. Where less than 24 hours notice is given, or our team has already been dispatched to the Site, Waste Collection Stockwell reserves the right to charge a reasonable cancellation or call-out fee to cover costs incurred.
6.2 Rescheduling
The Customer may request to reschedule a Booking, subject to availability. If the request is made with at least 24 hours notice, we will make reasonable efforts to accommodate the change without additional charges. Rescheduling requests made with shorter notice may incur an administration fee, especially where staff or vehicles have already been allocated.
6.3 Company Cancellations
Waste Collection Stockwell reserves the right to cancel or reschedule a Booking at any time where:
Weather or road conditions make it unsafe or impractical to carry out the Service.
Our staff face health and safety risks at the Site.
The information provided by the Customer is inaccurate or incomplete.
Operational reasons require us to amend our schedule.
In such cases, we will use reasonable endeavours to notify the Customer and offer an alternative date or time. Our liability in such circumstances will be limited to rearranging the Service or, where payment has been made in advance and no Service is provided, refunding the relevant amount.
7. Waste Regulations and Prohibited Items
Waste Collection Stockwell operates in compliance with UK waste management laws and regulations, including duties relating to the handling, transportation, and disposal of waste.
7.1 Prohibited or Restricted Waste
Without prior written agreement and where legally permitted, we will not collect or transport:
Hazardous waste such as chemicals, solvents, asbestos, certain paints, and toxic substances.
Clinical or medical waste, including sharps and biological material.
Gas bottles, pressurised containers, explosives, and flammable materials beyond ordinary household levels.
Liquids and oils not declared in advance.
Any item that is illegal to possess, transport, or dispose of.
The Customer is responsible for informing us in advance of any waste that may be classified as hazardous or controlled under applicable regulations. If we arrive on Site and discover prohibited waste, we may refuse to collect such items and may charge a reasonable fee for time and travel.
7.2 Duty of Care and Waste Transfer
Where required by law, Waste Collection Stockwell will complete appropriate documentation for the transfer of waste, such as a waste transfer note or consignment note. The Customer must provide accurate information to complete such documents, including descriptions of the Waste and its origin.
Waste Collection Stockwell will transport collected Waste only to authorised facilities for recycling, recovery, or disposal in accordance with applicable laws and environmental regulations.
8. Access, Health and Safety
The Customer must ensure that our staff have safe and unobstructed access to the Waste at the agreed time. This may include ensuring that parking is available or that any required permits are obtained. Where access is restricted or parking is unavailable, delays or additional charges may occur.
We reserve the right to refuse or suspend the Service if our staff believe that their health or safety is at risk, including due to dangerous conditions on Site, aggressive behaviour, the presence of hazardous substances, or unsafe structures.
9. Liability and Limitations
9.1 General Liability
Waste Collection Stockwell will exercise reasonable care and skill in providing the Service. However, we will not be liable for any loss, damage, or expense suffered by the Customer except where caused directly by our negligence or breach of these Terms and Conditions.
9.2 Limits on Liability
To the fullest extent permitted by law:
Our total liability for any claim arising out of or in connection with the Service shall not exceed the total price paid or payable by the Customer for that specific Service.
We shall not be liable for any indirect or consequential loss, including loss of profits, loss of business, loss of data, or loss of opportunity.
Nothing in these Terms and Conditions limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded.
9.3 Property Damage
The Customer must inform us before the Service begins of any fragile surfaces, delicate fixtures, or areas of special concern. While our staff take reasonable care, we are not responsible for wear, scuffs, or minor cosmetic marks that may arise from the normal movement of waste, containers, or equipment, particularly in tight spaces or on pre-existing damaged surfaces.
10. Complaints and Disputes
If the Customer is dissatisfied with any aspect of the Service, they should notify Waste Collection Stockwell as soon as possible, providing full details of the issue. We will investigate and seek to resolve complaints promptly and fairly.
Where a dispute cannot be resolved directly, the parties may consider using alternative dispute resolution methods where appropriate. These Terms and Conditions do not affect any statutory rights the Customer may have under consumer protection law.
11. Data Protection and Privacy
Waste Collection Stockwell collects and uses personal information provided by Customers for the purposes of managing Bookings, delivering services, processing payments, and fulfilling legal obligations. We will handle personal data in accordance with applicable data protection laws in the United Kingdom.
We may retain records of Bookings, invoices, and related communications for a reasonable period as required for business, regulatory, or tax purposes.
12. Changes to Terms and Services
Waste Collection Stockwell may update these Terms and Conditions from time to time to reflect changes in law, regulation, or business practice. The updated Terms and Conditions will apply to new Bookings from the date they are published or communicated to Customers.
We may also vary or discontinue certain services, pricing, or operational practices where necessary. Any such changes will not affect confirmed Bookings already accepted, except where required by law or by mutual agreement.
13. Force Majeure
Waste Collection Stockwell shall not be liable for any delay or failure to perform the Service due to events beyond our reasonable control, including but not limited to severe weather, natural disasters, acts of war or terrorism, civil unrest, strikes, lockouts, power failures, or breakdowns in transport or communication systems.
Where a force majeure event occurs, we will endeavour to notify the Customer and perform the Service as soon as reasonably practicable after the event has ceased.
14. Governing Law and Jurisdiction
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Service, shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising from or related to these Terms and Conditions or the Service, whether contractual or non-contractual.
15. General Provisions
If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by a court or regulator, that provision shall be deemed modified to the minimum extent necessary to make it valid, lawful, and enforceable, and the remaining provisions shall continue in full force and effect.
No failure or delay by Waste Collection Stockwell in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.
The Customer may not assign or transfer any of their rights or obligations under these Terms and Conditions without the prior written consent of Waste Collection Stockwell. We may assign or transfer our rights and obligations where reasonably required as part of our business operations, provided that this does not reduce the protection afforded to the Customer under these Terms and Conditions.
By making a Booking or using our services, the Customer confirms that they have read, understood, and agree to be bound by these Terms and Conditions.
